Josephine Cantona Wellness Retreats
- Terms & Conditions -

The following booking conditions apply to our yoga retreats (Portugal and France). Please read carefully when considering booking your retreat with us. 

In these booking conditions the 'retreater' means all persons booked on our retreats.

PAYMENTS & BOOKING YOUR RETREAT

To make a booking, you must confirm to us in writing you would like to book, and make the deposit payment.
We will confirm the booking with you by email once your deposit payment has been received. The prices stated for the retreat include the yoga and other practices, food and accomodation.
Prices do not include your travel, insurance of any kind or any other item not specifically referred to in the itinerary.

Payment method is by bank transfer or Paypal.

Bookings made 8 weeks before the 1st retreat day requires a deposit  - the amount is retreat dependent (please see specific retreat info). The retreater will then be notified by email of the balance owing which is due 6 weeks before the retreat commences, unless otherwise agreed.

The deposit of the yoga retreat is payable at the time of booking and will only be refunded should we (Josephine Cantona Wellness Retreats and co-teachers) cancel the retreat.

For bookings made less than 6 weeks before arrival, the full amount of the yoga retreat is payable to confirm the booking - unless otherwise agreed. Payments for external or additional items booked on a retreater's behalf are payable in full at the time of booking.

The retreater making the booking shall be liable for full payment for all those retreaters to whom the booking applies and for any other person subsequently added to the booking unless otherwise agreed.

These terms and conditions, deposit payment & written confirmation of booking form the basis of the contract between the retreater and Josephine Cantona Wellness Retreats. In all cases, the retreater accepts that it is their responsibility to check the details carefully. All discrepancies must be brought to the attention of Josephine Cantona Wellness Retreats in writing, within 7 days of the booking/deposit payment.

 

ALTERATION OF THE YOGA RETREAT BY THE RETREATER

Amendments or alterations to a booking must be made in writing to us. The retreater will be advised of any changes in costs that might occur as a result.

 

ALTERATION OF THE YOGA RETREAT BY JOSEPHINE CANTONA WELLNESS RETREATS

Should any significant alteration to any yoga retreat for which a booking has been made become necessary, the retreater shall be informed. The retreater shall be offered the choice of accepting the alteration, or a full refund of monies paid, as long as the client has not yet arrived on retreat. ​

 

CANCELLATION OF THE YOGA RETREAT BY JOSEPHINE CANTONA WELLNESS RETREATS

If through circumstances beyond our control, we are forced to cancel a booking, the client may choose a full refund or accept an equivalent retreat.

Circumstances beyond our control do not include events amounting to “force majeure”. Force majeure means unusual and unforeseen events such as war, threat of war, riot, terrorism, natural disasters, fire, public health crisis, technical problems or accidents with airports, ports or transport, inclement weather or governmental action. Josephine Cantona Wellness Retreats shall have no responsibility or legal liability to compensate the client for loss of opportunity to attend the yoga retreat.

Covid_19
Should you need to cancel the retreat due to flight restrictions, testing, quarantine ~ we can offer a full refund up to 45 days before the retreat start date once we receive appropriate proof of Covid-related reasons.​

Please also note, a visa to travel to Portugal may be required, as may Covid tests. These will be your responsibility, although of course we will help in any way we can.​

 

CANCELLATION OF THE YOGA RETREAT BY THE RETREATER

Cancellations must be received in writing.

A cancellation made more than 60 days before arrival, we will offer a full refund minus your deposit.

A cancellation made within 60 – 45 days before arrival, you will receive 50% refund (not including the deposit).

A cancellation made less than 45 days before arrival or no-show will automatically be considered as non-refundable.

 

PERSONAL INJURIES OR MEDICAL CONDITIONS

We will ask you for previous medical conditions to ensure we adapt our classes accordingly and avoid anything that may cause harm. This is your responsibility to inform us on the medical/information questionnaire emailed to you before the retreat.

We cannot be held responsible for any mishap to clients or their property and in particular for the consequences of the effects of strikes, wars, acts of terrorism, riots, robbery, sickness, quarantine, government intervention or other such happenings.
We strongly advise you take out appropriate insurance at the time of booking.

LIABILITY OF THE RETREATER

All retreaters undertake to behave in such a manner as to cause no damage, distress, danger or annoyance to other retreaters, property and/or any third party. The contract of any retreater in breach of this clause shall be terminated immediately and we shall have no further contractual obligations. In circumstances reasonably deemed by us to be extreme, including significant damage, significant antisocial behaviour or illegal activities; Josephine Cantona Wellness Retreats reserve the right to cancel the yoga retreat & request the retreater to leave the retreat without compensation.

The retreater undertakes to report any damage, deliberate or accidental damage to Josephine Cantona Wellness Retreats and we reserve the right to recover from the retreater the cost of any repairs or replacements following damage caused by the retreater.​​

 

INSURANCE

It is a condition of booking that retreaters have appropriate insurance at the time of booking. This insurance must cover all activities chosen during the retreat and cover public liability, property damage and its contents, cancellation of the retreat and the cost of assistance, including repatriation, in the event of accident or illness.

We do not provide any travel, sports or other insurance to our retreaters. Ensuring you have the right cover for any potential accident, mishap or illness that occurs during your retreat is your own responsibility. We also advise you should obtain adequate cover for your personal items. The retreater also understands that passport, visa and immigration requirements are managed by them, and we do not offer these services or any required Covid_19 testing.

We will not be held liable, nor pay any compensation, in the event of any injuries, deaths, losses, damages, costs or any other manner of claims if they arise due to the acts or omissions of the person or persons affected, or the acts or omissions of third parties unaffiliated with the service provisions covered within and defined by these terms if they were unavoidable, unforeseeable, or unusual circumstances which are beyond the control of us or our suppliers, resulting in consequences that could not have been avoided regardless of all due care.​

 

SERVICES PROVIDED BY THE THIRD PARTIES

Bookings for extra excursions/services, such as airport transfers, excursions, restaurant bookings, sauna/steam, treatments made on your behalf by Josephine Cantona Wellness Retreats are subject to the terms and conditions laid down by the provider of the service. Josephine Cantona Wellness Retreats do not warrant the standard or performance of any extra services. The retreater takes full responsibility for satisfying themselves as to the quality and the provider’s ability to execute the services in advance and will address any grievance about the extra services by approaching the respective provider(s) directly.​

 

WEATHER CONDITIONS

Weather conditions may affect the itinerary. Some of the activities during the yoga retreat may be impacted due to weather conditions. If we suspect weather conditions are not appropriate, we might reschedule the activities. If it is not possible to reschedule, we will cancel the activities. No compensation may be asked by the retreater.​

 

COMPLAINTS PROCEDURE

In the unlikely event that difficulty arises during your yoga retreat you should advise Josephine Cantona Wellness Retreats and co-teachers who will endeavor to resolve the difficulty. 

Please note that no liability can be accepted for any complaint where a retreater has not followed this complaints procedure.

WEBSITE INFORMATION & ACCURACY

All reasonable care has been taken to ensure that the descriptions, facts and opinions on our website are correct to the best of our knowledge.

 

TRANSPORTATION AND TRANSFERS

It is the retreater responsibility to organise transportation to the retreat location in order to arrive and depart respecting the times mentionned on our retreat schedule. ​
 

FOOD

It is the retreaters responsibility to advise of any food allergies & intolerance's in their health questionnaire. 
We will endeavor to ensure dietary requirements are met based on this information when we cater.

You must personally advise of any allergies & intolerance's to the retreat locations's chefs & any external caterers/restaurants we may experience.

PRIVACY

We do not share customer details with any 3rd parties without your express consent, and then only in order to facilitate the booking of 3rd party services such as excursions, treatments, restaurant bookings. 

 

JURISDICTION

These terms and conditions and the contract to which they apply are governed in all respect by Portuguese law and as such shall be subject to the exclusive jurisdiction of the courts of Portugal.

By booking a retreat with us, you agree to these Terms & Conditions.
